Welcome to referencerealestate.mx (the “Site”). Access to, browsing of, and use of the Site are governed by these Terms and Conditions of Use (the “Terms”).
The Site is operated by SERVICIOS NUNVAZ, trading as “Reference Real Estate” (hereinafter “Reference Real Estate,” “we,” or the “Controller”), with registered address at AV. BAJA CALIFORNIA 274, PISO 2-B, COL. HIPODROMO, CUAUHTEMOC, MEXICO CITY, C.P. 06100, and contact email info@referencerealestate.mx.
By accessing, browsing, using the Site, or submitting information through its forms, you accept these Terms. If you do not agree with them, you must refrain from using the Site.
1. Purpose of the Site
The purpose of the Site is to provide information about real estate properties, brokerage services, advisory, and real estate promotion in Mexico, with a focus on the luxury residential and vacation segment.
The Site serves as an informational, commercial, and lead-generation channel between interested users and Reference Real Estate, without the mere browsing of the Site creating any obligation for either party.
2. Informational nature; no binding offer
All information contained on the Site —including, without limitation, property descriptions, prices, features, renders, photographs, floor plans, locations, amenities, and projections— is exclusively informational and for guidance purposes only.
The publication of information on the Site does NOT constitute:
- a) A binding offer to buy, sell, lease, or enter into any other legal act;
- b) A promise to sell or lease;
- c) A guarantee of availability of listed properties;
- d) A guarantee that displayed prices are final or definitive;
- e) Legal, tax, or financial advice;
- f) An obligation to close any transaction.
Any real estate transaction will be subject to the execution of specific contracts, availability validation, verification of conditions, and compliance with applicable legal requirements.
3. Property information
Reference Real Estate makes reasonable efforts to keep the information published on the Site up to date. However, the user acknowledges and accepts that:
- a) Prices may change without prior notice and are subject to variations due to exchange rates, market conditions, or decisions by the developer or owner;
- b) Property availability may vary in real time;
- c) Images, renders, floor plans, and graphic materials are illustrative and may not accurately reflect the current or final condition of the properties;
- d) Areas, measurements, characteristics, and specifications must be verified directly with the developer or owner;
- e) Closing costs, taxes, notarial fees, commissions, and other charges associated with a transaction are not necessarily included in published prices;
- f) Past performance of a real estate investment does not guarantee future results;
- g) Reference Real Estate is not responsible for information provided by third-party developers, owners, or collaborating agents.
It is the user’s responsibility to verify all information directly with Reference Real Estate advisors before making any decision.
4. Contact, forms, and lead generation
The Site may include contact forms, WhatsApp buttons, email links, and other communication mechanisms. Submitting information through these means does NOT create:
- a) A contractual relationship between the user and Reference Real Estate;
- b) Automatic acceptance of the user as a client;
- c) Exclusive representation of the user;
- d) An obligation to process the request.
The user agrees to provide truthful and up-to-date information when using the Site’s forms.
5. Tools, calculators, and projections
The Site may offer interactive tools, mortgage calculators, return-on-investment simulators, or other projections. Such tools are exclusively informational and for guidance purposes, and do NOT constitute financial, tax, or legal advice.
The results generated depend on data entered by the user and on assumptions that may not correspond to actual market conditions. Reference Real Estate does not guarantee the accuracy, currency, or applicability of such results.
6. Third-party platforms and services
The Site may use third-party platforms —such as EasyBroker, real estate portals, social media, analytics services, CRM, and marketing tools— for property listings, contact management, or traffic analysis.
The use of such platforms does not imply that Reference Real Estate guarantees the information published therein by third parties.
External links that may appear on the Site are provided as references and are governed by their own terms and privacy policies.
7. User obligations
The user agrees to use the Site lawfully, in accordance with these Terms, applicable legislation, and good faith. The following is expressly prohibited:
- a) Using the Site for unlawful purposes or purposes contrary to these Terms;
- b) Providing false, misleading, or fraudulent information;
- c) Attempting to access restricted areas of the Site without authorization;
- d) Interfering with the operation of the Site or its systems;
- e) Introducing viruses, malware, or any malicious code;
- f) Scraping, mass data extraction, or data mining;
- g) Copying, reproducing, distributing, or exploiting Site content without written authorization;
- h) Using Site information for unfair competition or acts that harm Reference Real Estate.
8. Intellectual property
All content on the Site —including, without limitation, text, designs, logos, images, photographs, videos, source code, trademarks, trade names, and graphic layout— is the property of Reference Real Estate and/or SERVICIOS NUNVAZ, or is used under license from their respective owners.
Reproduction, distribution, public communication, transformation, or any other use without prior written authorization is prohibited. Access to the Site does not grant the user any express or implied license over the intellectual property rights of Reference Real Estate.
9. Limitation of liability
To the fullest extent permitted by law, Reference Real Estate shall not be liable for:
- a) Interruptions, errors, or difficulties in accessing the Site;
- b) Inaccuracies, errors, or omissions in published information;
- c) Changes in prices, availability, or conditions of properties;
- d) Investment, purchase, sale, or lease decisions made by the user based on information from the Site;
- e) Technical failures, data loss, or security vulnerabilities;
- f) Acts or omissions by third parties, including developers, owners, notaries, financial institutions, or any other agent involved in a real estate transaction.
This limitation does not exclude liability that cannot be waived by law.
10. Privacy and personal data
The processing of personal data collected through the Site is governed by our Privacy Notice, available at https://www.referencerealestate.mx/en/privacy.
Use of the Site implies acknowledgment and acceptance of said Privacy Notice.
11. Modifications
Reference Real Estate reserves the right to modify at any time and without prior notice:
- a) The content of the Site;
- b) Listed properties;
- c) Available functionalities;
- d) These Terms and Conditions of Use.
Modifications will become effective upon publication on the Site. Continued use of the Site after any modification constitutes acceptance of the updated Terms.
12. Applicable law and jurisdiction
These Terms are governed by and construed in accordance with the laws of the United Mexican States.
For any dispute arising from the use of the Site or the interpretation of these Terms, the parties submit to the jurisdiction of the competent courts of Mexico City, expressly waiving any other jurisdiction that may correspond to them by reason of present or future domicile.
The foregoing does not limit the user’s consumer protection rights under applicable law.
